Terms of Service

These Terms of Service ("Terms") govern your use of My Big Empire at mybigempire.com and every page under it. By creating an account or using the service, you agree to these Terms. If you are a consumer, you have additional rights that these Terms do not limit.
1. Who we are
My Big Empire is operated by Ondřej Danielovský registered in the Czech Republic, with its place of business at Kožlany, Czech Republic, Company ID 87772442 ("we", "us", "our").

2. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the service. If you use the service on behalf of an organization, you confirm that you are authorized to do so.
3. The service
My Big Empire provides a public showcase page (your "Empire profile") and a private dashboard for your projects, a daily log, a plan, and site-monitor settings. Some features may be free and some may be paid. We may change, suspend, or discontinue features at any time.
We do not guarantee uninterrupted or error-free availability. The service is not a project-management, accounting, or backup system, and it is not a substitute for keeping your own copies of important information.
We may keep limited first-party usage statistics about how the service is used. Details are described in our Privacy Policy.
4. Your account
- You sign in with a six-digit code sent to your e-mail address, or with Google. There is no password.
- One account per verified e-mail address.
- You are responsible for keeping access to your e-mail and Google account secure, and for all activity under your account.
- Provide accurate information. Do not impersonate others or create accounts to abuse the service.
5. Price and payment
The service is currently free. We may introduce paid plans in the future and will notify you well in advance. Nothing becomes chargeable without your explicit consent.
- Prices for paid features are shown on our website before you buy, in the currency stated at checkout.
- Payments are processed by Stripe. By paying, you also agree to Stripe's terms and privacy policy. We do not receive or store your card number.
- If a paid feature is a subscription, it renews automatically until you cancel. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- When you buy, you enter a contract with us, and your order is confirmed by e-mail or in the app.
6. VAT
We are a Czech VAT payer. Prices shown to consumers include VAT where applicable. For digital services supplied to consumers in other EU member states, we charge VAT of the customer's member state under the One Stop Shop (OSS). If you provide a valid VAT number, the applicable VAT treatment will be reflected in your invoice.
7. Right of withdrawal and cancellation
If you are a consumer, you may withdraw from a paid purchase or subscription within 14 days of entering into the contract, without giving any reason. To do so, contact us at beda@vomatchka.com. We will refund the full amount you paid, using the same means of payment, without undue delay and no later than 14 days after we receive your withdrawal. You may withdraw even if you have already started using the paid features.
For subscriptions, you may cancel at any time in your account or by contacting us; cancellation takes effect at the end of the current billing period. The 14-day withdrawal period applies to your first purchase of a subscription, not to its automatic renewals. Any mandatory consumer rights remain unaffected.
The right of withdrawal does not apply to business customers (non-consumers), nor where the law excludes it.
8. Refunds
Apart from the 14-day withdrawal described in section 7, we provide refunds where required by law or where we choose to grant one. This does not affect your statutory rights for defective content.
9. Delivery of digital content
Paid digital features are delivered electronically, usually immediately after your payment is confirmed (for example by unlocking the feature in your account). If you do not receive what you paid for, contact us and we will resolve it.
10. Acceptable use
You must not:
- break any law or infringe anyone's rights;
- publish illegal, infringing, hateful, harassing, or deceptive content;
- post links to malware, phishing, or scams;
- upload or publish other people's personal data without permission;
- try to bypass security, rate limits, or access controls, or access another user's private data;
- scrape, overload, or otherwise interfere with the service or other users;
- use the service to send spam.
We may remove content and suspend or terminate accounts that break these rules.
Reporting and moderation. To report illegal content, write to beda@vomatchka.com with the page URL and why you think it is illegal. This address is also our point of contact under the Digital Services Act. If we remove content or restrict an account, we tell the affected user why and how to object, unless the law prevents us.
Site monitor and links. Only add websites you own or are allowed to monitor. Links and monitor URLs on a public Empire are shown in full to everyone, so never include passwords or tokens in them.
11. Your content and licence
You keep ownership of the content you add - your projects, log, plan, site monitor URLs, and your Empire name. To operate the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content, including on your public profile when you choose to make it public. This licence ends when you delete the content or your account, except for copies already shared with others or kept in backups for a limited time.
You are responsible for your content and confirm that you have the rights needed to post it.
12. Public and private content
Your content is private by default. You choose which dashboard cards are visible on your public Empire page. Anything you make public can be seen and shared by anyone. Do not publish anything you do not want to be public.
13. Our intellectual property
The service itself - including its name, design, and software - belongs to us or our licensors. You may not copy, modify, distribute, or reverse-engineer it except where the law allows or with our permission.
14. Third-party services and links
The service uses Google for sign-in, Stripe for payments, and may link to third-party websites (for example the projects you list). We are not responsible for third-party services or content, and their own terms and privacy policies apply to them.
15. Statutory rights for defective content
If you are a consumer, we are liable for the conformity of digital content and services with the contract, under the applicable Czech and EU consumer law (including the rules implementing Directive (EU) 2019/770). You may exercise your statutory rights (for example repair, replacement, price reduction, or termination) by contacting us. The statutory liability period is 24 months from supply; where the supply is continuous, we are liable for defects that become apparent during the period of supply. These rights are independent of the right of withdrawal and of any goodwill refund.
16. Complaints and dispute resolution
If you have a complaint, contact us first at beda@vomatchka.com and we will try to resolve it. If you are a consumer and we do not agree, you may contact the Czech Trade Inspection Authority (coi.cz) for out-of-court resolution.
17. Termination
You may stop using the service at any time and request deletion of your account by contacting us. We may suspend or terminate your access if you break these Terms or to protect the service or other users.
Free accounts. While the service is free, we may delete a free account that has been inactive (no login or activity) for more than 90 days. Before doing so, we will send a notice to the e-mail address on the account and allow at least 14 days to log in and keep the account. We may also suspend or delete any account that contains content violating section 10 (Acceptable use), as reasonably determined by us.
18. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that data will never be lost. Keep your own copies of important information. This does not limit your statutory consumer rights described in section 15.
19. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, profit, or goodwill arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
20. Changes to these Terms
We may update these Terms from time to time. We will change the "last updated" date above and, for material changes, notify you. Continued use of the service after a change means you accept the updated Terms, without affecting rights already acquired.
21. Governing law and jurisdiction
These Terms are governed by the laws of the Czech Republic, together with applicable European Union law, including consumer-protection rules. If you are a consumer, you benefit from the mandatory consumer protection of your country of residence. Disputes will be handled by the competent courts of the Czech Republic, unless mandatory law gives you the right to bring proceedings elsewhere.
